World of Wonder LLC Permission to Participate
On behalf of my minor child, I hereby give permission for my child
to participate in the World of Wonder Hybrid Homeschool Program ("WOW Program"). I
acknowledge and agree to the following:
1. Voluntary Participation: I understand and agree that my child's participation in the
WOW Program is wholly voluntary and not part of any mandatory school curriculum. I
recognize that the activities offered by the WOW Program involve certain inherent risks,
including but not limited to physical activity, outdoor activities, and interactions with other participants, which may result in injury, illness, or other unforeseen consequences.
2. Assumption of Risk: I voluntarily assume all risks and hazards associated with my
child's participation in the WOW Program. This includes, but is not limited to, risks
arising from physical exertion, environmental conditions, the use of equipment, and any
other activities related to the program. I understand that these risks may lead to serious
injury, illness, or even death.
3. Release of Liability: To the fullest extent permitted by law, I hereby release, discharge, and hold harmless World of Wonder LLC, its directors, officers, employees, contracted employees, independent contractors, instructors, agents, organizers, volunteers, and affiliates (collectively, "WOW Parties") from any and all liability for any injury, damage, loss, or expense of any kind that may arise out of or in connection with my child's participation in the WOW Program, whether caused by the negligence of the WOW Parties or otherwise.
4. Indemnification: I agree to indemnify, defend, and hold harmless the WOW Parties from any and all claims, actions, suits, demands, losses, liabilities, damages, costs, and
expenses (including reasonable attorney’s fees) arising out of or related to my child's
participation in the WOW Program, including claims brought by third parties.
5. Medical Treatment: I understand that in the event of a medical
emergency, WOW will make every reasonable effort to contact the emergency contact(s) listed on file. However, if immediate medical attention is required, I consent to my child receiving such treatment as deemed necessary by qualified medical personnel. I acknowledge that I am solely responsible for any and all medical expenses incurred as a result of my child's participation in the WOW Program.
6. No Warranty of Safety: I acknowledge that WOW makes no warranties or guarantees regarding the safety of the activities or equipment used in the WOW Program. I accept that accidents and injuries may occur, and that WOW cannot eliminate all risks associated with my child's participation.
7. Binding Effect: This agreement is binding on me, my child, and our respective heirs,
assignees, executors, administrators, guardians, and legal representatives. I further
agree that this release and waiver shall be governed by and interpreted in accordance
with the laws of the state in which the WOW Program is conducted.
8. Severability: I agree that if any provision of this agreement is found to be unenforceable
or invalid, that provision shall be severed from this agreement and the remaining
provisions shall remain in full force and effect.
9. Entire Agreement: This agreement constitutes the entire understanding between WOW and me concerning the subject matter herein, and it supersedes all prior discussions, agreements, or understandings of any kind, whether written or oral. No modification or amendment to this agreement will be effective unless in writing and signed by both parties.
Acknowledgment and Consent: By signing below, I acknowledge that I have read,
understood, and voluntarily agree to the terms of this Waiver of Liability, Release, Assumption of
Risk, and Indemnity Agreement. I further confirm that I have the legal authority to sign on behalf
of my minor child.
